Adamaris Guereca sued by North Little Rock district over payroll mix-up
Adamaris Guereca faces a lawsuit filed by officials in North Little Rock over mistaken payments. The district wants more than $12,000 back following five direct payroll deposits.
The civil complaint was filed on Oct. 9 in Pulaski County. It names the 19-year-old Springdale resident as the defendant.
Guereca received $12,755.62 between May 22 and June 23, the complaint alleges. The money arrived through five direct payroll deposits.
She is not an employee or contractor with the district, the suit states. Her bank balance stood at zero when the first deposit arrived.
The deposits bore the label “NLR School Dist PAYROLL,” the filing says. Guereca withdrew the cash. Her account went negative.
Officials sent two demand letters on Sept. 9, the complaint says. One letter was registered and one was not. Both asked for full repayment by Sept. 23.
The certified letter was returned to sender Sept. 30, according to the complaint. The standard letter was not returned.
The lawsuit states Guereca is guilty of conversion, unjust enrichment and felony. The North Little Rock claims exceed $1,000.
Civil lawsuits allow organizations to seek repayment through county courts. A conversion claim asserts that someone wrongfully took property. Judges or juries decide whether repayment is required.
The filing asks for a jury trial and return of the funds. It also seeks interest, legal fees and punitive damages. Guereca has until Nov. 8 to file an answer, according to the summons.
