Austin McCollum bond increased following arrest in Benton County charges

Former state representative Austin McCollum appeared in a Benton County court on Oct. 5 for a bond hearing. Judge Brad Karren decided not to revoke bail but raised the required amount in an assault case.

McCollum faces multiple charges across two separate criminal cases. He was arrested on Sept. 29 for first-degree stalking and violation of a protection order charges.

Four people testified on behalf of the state during the hearing. Defense counsel had filed a motion to reduce the amount. The motion stated that McCollum has no history of failing to appear in court.

Judge Brad Karren denied the defense request. Karren stated that counsel could refile the motion if new information becomes available.

The judge raised bail in the aggravated assault case from $10,000 to $75,000. McCollum must also wear an ankle monitor upon release.

Bail in the stalking case was previously set at $150,000 cash only. McCollum is 35 years old and previously ran as a county judge candidate.

His first arrest occurred on Aug. 1. He was charged with felony counts of domestic battering, aggravated assault, and false imprisonment. He pleaded not guilty.

An affidavit states an argument occurred between McCollum and his wife. The document alleges he restricted her breathing with a knee on her neck. It also alleges he punched her face, threw her down, and slammed her head.

His wife filed for divorce after that incident. A court granted an order of protection prohibiting McCollum from several locations:

  • His wife’s home
  • His wife’s place of work
  • The children’s school
  • His wife’s church

Prosecutors say McCollum violated the protective order on multiple occasions. These allegations led to the September arrest in Benton County.

A bond revocation hearing allows a court to decide if a defendant may remain free before trial. Judges can alter financial conditions or impose monitoring rules.

McCollum is scheduled to return to a Benton County courtroom on Nov. 2 for the stalking case. His next hearing in the assault case is set for Dec. 1.
